{"id":178,"date":"2018-11-12T12:00:00","date_gmt":"2018-11-12T12:00:00","guid":{"rendered":"http:\/\/www.consumerslaw.com\/blog\/how-stand-against-collection-agency-harassment\/"},"modified":"2020-03-15T16:35:50","modified_gmt":"2020-03-15T16:35:50","slug":"how-stand-against-collection-agency-harassment","status":"publish","type":"post","link":"https:\/\/www.consumerslaw.com\/blog\/how-stand-against-collection-agency-harassment\/","title":{"rendered":"Stand Up to Collection Agency Harassment"},"content":{"rendered":"<p>You might owe money on a credit card or loan, a utility or medical debt, but you still have rights against abusive debt collectors.\u00a0 Read more to learn about your rights.<\/p>\n<p><!--more--><\/p>\n<h2>Consumers have rights.<\/h2>\n<p>The <a href=\"https:\/\/www.consumerslaw.com\/practice-areas\/debt-collection\/common-violations-fdcpa\" target=\"_blank\" rel=\"noopener\">Fair Debt Collection Practices Act (FDCPA)<\/a> is a federal law that offers protections to consumers when collectors call about personal debts, such as credit cards, medical bills, utility bills or loans.<\/p>\n<h2>The collection process<\/h2>\n<p>Once the debt has moved from the creditor to a collector, the FDCPA must be followed.\u00a0 If the collector uses tactics which violate the FDCPA,\u00a0 the consumer may file a lawsuit against the collector.\u00a0 Lawsuits pursued under the FDCPA provide for the debt collector to pay the consumer\u2019s legal fees \u2013 whether the debt is owed or not.\u00a0 Beware a collector&#8217;s violating tactics, such as:<\/p>\n<ol>\n<li><strong>Not providing proof of the debt<\/strong><br \/>\nCollectors must inform the consumer with the name of the original creditor, how much is owed, and provide proof of how the debt was calculated.<\/li>\n<li><strong>Misrepresenting the debt<\/strong><br \/>\nDebt collectors must be truthful.
