If you are unable to pay your car loan on time, the lender may choose to repossess your vehicle.\u00a0<\/span><span id=\"docs-internal-guid-e64fa32d-69ee-df68-521b-80ef63bb7b6f\">However, the lender must handle the repossession properly &#8211; whether you have fallen behind or not.\u00a0 \u00a0<\/span><\/p>\n<h2 dir=\"ltr\"><span id=\"docs-internal-guid-e64fa32d-69ee-df68-521b-80ef63bb7b6f\">1) Seek a Deferment Before Default\u00a0<\/span><\/h2>\n<p dir=\"ltr\"><span id=\"docs-internal-guid-e64fa32d-69ee-df68-521b-80ef63bb7b6f\">Contact your lender before you default to see if a deferment is possible. A deferment will postpone your payments while you catch up with finances. These postponed payments are then applied to the end of the loan.<\/span><\/p>\n<p dir=\"ltr\"><span id=\"docs-internal-guid-e64fa32d-69ee-df68-521b-80ef63bb7b6f\">It is important to receive written confirmation from the lender showing this change to the original loan agreement. Since the terms of the loan have, in effect, been extended, the consumer needs to see how the lender has calculated any additional money to be paid at the end to satisfy the loan.<\/span><\/p>\n<p dir=\"ltr\"><span id=\"docs-internal-guid-e64fa32d-69ee-df68-521b-80ef63bb7b6f\">A deferment will likely still appear on your credit report, but the effect on your credit will not be as negative as a default.<\/span><\/p>\n<h2 dir=\"ltr\"><span id=\"docs-internal-guid-e64fa32d-69ee-df68-521b-80ef63bb7b6f\">2) Prepare for Repossession<\/span><\/h2>\n<p dir=\"ltr\"><span id=\"docs-internal-guid-e64fa32d-69ee-df68-521b-80ef63bb7b6f\">If your loan is in default, understand that the lender has the right to repossess your vehicle.\u00a0<\/span><span id=\"docs-internal-guid-e64fa32d-69ee-df68-521b-80ef63bb7b6f\">If you think a repossession is coming:<\/span><\/p>\n<ul>\n<li dir=\"ltr\"><span id=\"docs-internal-guid-e64fa32d-69ee-df68-521b-80ef63bb7b6f\">Remove all important car vehicle purchase and loan documents from your vehicle<\/span><\/li>\n<li dir=\"ltr\"><span id=\"docs-internal-guid-e64fa32d-69ee-df68-521b-80ef63bb7b6f\">Remove all personal items. <\/span><\/li>\n<li dir=\"ltr\"><span id=\"docs-internal-guid-e64fa32d-69ee-df68-521b-80ef63bb7b6f\">Note the current odometer reading\u00a0<\/span><\/li>\n<li dir=\"ltr\"><span id=\"docs-internal-guid-e64fa32d-69ee-df68-521b-80ef63bb7b6f\">Take photographs of the vehicle &#8211; interior and exterior. <\/span><\/li>\n<li dir=\"ltr\"><span id=\"docs-internal-guid-e64fa32d-69ee-df68-521b-80ef63bb7b6f\">Request that the lender provide you with a written <a title=\"Loan Payment History\" href=\"https:\/\/www.consumerslaw.com\/assets\/Uploads\/7a085878f2\/Request_Loan_Agreement.pdf\" target=\"_blank\" rel=\"noopener noreferrer\">loan payment history<\/a>\u00a0and a payoff figure.<\/span><\/li>\n<\/ul>\n<h2 dir=\"ltr\"><span id=\"docs-internal-guid-e64fa32d-69ee-df68-521b-80ef63bb7b6f\">3) Evaluate how to Get Your Vehicle Back<\/span><\/h2>\n<p dir=\"ltr\"><span id=\"docs-internal-guid-e64fa32d-69ee-df68-521b-80ef63bb7b6f\">The loan agreement that you sign at the time of purchase details your rights if the vehicle is repossessed. If you financed through the dealership, this document is called the <a title=\"Retail Installment Sales Contract\" href=\"https:\/\/www.consumerslaw.com\/assets\/Uploads\/68011b4f4d\/CarRepo-RISC1.pdf\" target=\"_blank\" rel=\"noopener noreferrer\">Retail Installment Sales Contract<\/a> or RISC. It will state whether you must pay off the full balance of the loan, pay only past due payments, and pay for towing and storage fees.<\/span><\/p>\n<p dir=\"ltr\"><span id=\"docs-internal-guid-e64fa32d-69ee-df68-521b-80ef63bb7b6f\">After the repossession, you are entitled to receive a notice that details the terms for you to get your car back. This notice may be called a <a title=\"Notice of Intent to Sell Property\" href=\"https:\/\/www.consumerslaw.com\/assets\/Uploads\/a6093fdc64\/CarRepo-NoticeIntentSell1.pdf\" target=\"_blank\" rel=\"noopener noreferrer\">Notice of Intent to Sell Property<\/a>.
