It is mailed to the borrower and will show the balance remaining on the loan, plus any additional charges, such as repossession and storage fees, the subtraction of the selling price of the car from the auction or private sale, and the final calculation, the Total Balance Owed, to satisfy the loan.<\/p>\r\n\r\n\r\n\r\n<h2>Not all repossessions happen by the book<\/h2>\r\n\r\n\r\n\r\n<p>Creditors have every right to repossess a vehicle if the borrower defaults on the terms of the loan. But there are limits.\u00a0 Consumer protection laws guard against abusive tactics used by lenders and repossession agents.\u00a0 No matter what happens when your car is repossessed in Pennsylvania, you still have rights.<\/p>\r\n\r\n\r\n\r\n<h4>The repo agent is barred from:<\/h4>\r\n\r\n\r\n\r\n<ul>\r\n<li>Trespassing on your property or coming into a closed garage to get your car\r\n<ul>\r\n<li>Coming in to your home without your invitation<\/li>\r\n<\/ul>\r\n<ul>\r\n<li>Damaging your car during repossession<\/li>\r\n<\/ul>\r\n<ul>\r\n<li>Causing you or anyone else on the scene physical harm<\/li>\r\n<\/ul>\r\n<ul>\r\n<li>Threatening you, either with arrest or violence<\/li>\r\n<\/ul>\r\n<ul>\r\n<li>Forcing you to pull over if you\u2019re driving<\/li>\r\n<\/ul>\r\n<ul>\r\n<li>Getting the police to help them repossess your car<\/li>\r\n<\/ul>\r\n<\/li>\r\n<\/ul>\r\n\r\n\r\n\r\n<div class=\"wp-block-image\">\r\n<figure class=\"alignright\"><img loading=\"lazy\" width=\"300\" height=\"199\" class=\"wp-image-598\" src=\"https:\/\/www.consumerslaw.com\/blog\/wp-content\/uploads\/2019\/04\/Child-seats-and-toys-in-minivan-300x199.jpg\" alt=\"\" srcset=\"https:\/\/www.consumerslaw.com\/blog\/wp-content\/uploads\/2019\/04\/Child-seats-and-toys-in-minivan-300x199.jpg 300w, https:\/\/www.consumerslaw.com\/blog\/wp-content\/uploads\/2019\/04\/Child-seats-and-toys-in-minivan-768x509.jpg 768w, https:\/\/www.consumerslaw.com\/blog\/wp-content\/uploads\/2019\/04\/Child-seats-and-toys-in-minivan.jpg 930w\" sizes=\"(max-width: 300px) 100vw, 300px\" \/><\/figure>\r\n<\/div>\r\n\r\n\r\n\r\n<p>In addition, the lender or repossession agent is not allowed to sell any personal property left behind in your car.\u00a0 All the same, we advise people to clear out their car in advance of a repossession.\u00a0 If you believe your car could be repossessed, remove all personal items, such as car purchase and loan documents, car seats, briefcases and school bags, and store them in a safe place.\u00a0 If your car is taken unexpectedly, you may not have a chance to remove these items during\u00a0 the repossession, and afterwards, it may cause undue stress and hardship to retrieve them.<\/p>\r\n\r\n\r\n\r\n<h2>Take these Steps<\/h2>\r\n\r\n\r\n\r\n<p>If you\u2019re worried the repo agent broke the rules, document the process.\u00a0 Write a detailed statement about what happened and when.\u00a0 Take photographs showing the condition of your car; note the odometer reading; get statements from witnesses; photograph or video record any identifying information about the repo agent, such as the company name and license plate; create a diary reflecting the event.\u00a0These details will assist a consumer protection attorney evaluate whether you are a victim of a wrongful repossession.<\/p>\r\n\r\n\r\n\r\n<h2>You have Rights Against Wrongful Repossession in Pennsylvania<\/h2>\r\n\r\n\r\n\r\n<p>Whether you had fallen behind on your car payments or not, or your vehicle was repossessed by mistake, the lender and\/or his repossession agent may have broken the law.
