Proper Repossession Notices
After a vehicle repossession, the lender must provide a Repossession Notice to the borrower confirming the vehicle was repossessed. The notice will explain terms to retrieve the vehicle, state any money owed, detail a deadline to act, and the date of an auction or sale.
Once the vehicle is sold, a lender will send a Deficiency Notice which confirms the selling price of the vehicle, and shows the calculation of any balance owed to satisfy the loan, or refund you are entitled to.
Wrongful Repossession
Repossession agents are not allowed to "breach the peace" in taking a vehicle. This means that they can not use physical force, threaten arrest, or damage personal property. Like all lenders, EMVLP II, LLC is responsible for the actions of their repo agent.
