EMVLP II, LLC

car repoWas your car repossessed by EMVLP II, LLC within the past six years? Your legal rights may have been violated.

EMVLP II, LLC is a State Farm–affiliated entity that owns/holds certain auto loans that were originally originated by State Farm Bank after the bank exited retail banking. EMVLP II, LLC has drawn complaints from auto-loan borrowers about how accounts are serviced and repossessions are handled. Consumers describe confusion during/after State Farm Bank loan transfers, reports of misapplied or uncredited payments, limited communication before a repossession, and steep hurdles to reinstate or redeem the vehicle—followed by negative credit reporting.

Whether you missed payments or not, the lender must follow the law.  Flitter Milz is a consumer protection law firm that represents borrowers against credit unions for improper tactics used in the repossession of personal vehicles -- new or used cars, trucks, motorcycles, powersports & ATVs.

There will be no cost to you, the borrower, for a legal review.

What to look for:
   - Loan Agreement
   - Repossession Notice or Notice of Disposition of Collateral
sent to you AFTER the repossession

Proper Repossession Notices
After a vehicle repossession, the lender must provide a Repossession Notice to the borrower confirming the vehicle was repossessed.  The notice will explain terms to retrieve the vehicle, state any money owed, detail a deadline to act, and the date of an auction or sale.
Once the vehicle is sold, a lender will send a Deficiency Notice which confirms the selling price of the vehicle, and shows the calculation of any balance owed to satisfy the loan, or refund you are entitled to.

Wrongful Repossession
Repossession agents are not allowed to "breach the peace" in taking a vehicle. This means that they can not use physical force, threaten arrest, or damage personal property.  In addition, police are not to assist the repo agent, threaten arrest, or command that your vehicle or keys be turned over to the repo agent. Like all lenders, EMVLP II, LLC is responsible for the actions of their repo agent.
