2009 WL 5184485 (E.D. Pa. 2009)
Case type: FDCPA Class Action
Federal court agreed that this collection firm's longstanding policy to arbitrate with the borrower absent from the arbitration proceeding violates the Pennsylvania rules governing arbitration of credit card disputes and was fundamentally unfair. This effectively precluded tens of millions of dollars in bogus arbitration awards against unwitting consumers from being enforced.
