Failure to Honor Gift Card – Appeal of class certification
When a clothing retailer gave promotional gift cards to its customers, they stated "No expiration date". But the company later said the cards expired and cancelled them. Flitter Milz served as part of the legal team who sued on behalf of the aggrieved consumers. After the trial court certified the class of consumers, the retailer appealed. The appellate court affirmed class certification, holding that all consumers do not need to be immediately identifiable in order to proceed as a class action.
