765 F.3d 299 (3d Cir. 2014)
In this important privacy rights decision, the U.S. Court of Appeals for the Third Circuit held for the first time that a debt collector violated the Fair Debt Collection Practices Act (FDCPA) by displaying a consumer's account number through the glassine window of a collection envelope. The Court agreed that this long-running practice in the debt collection industry could violate the consumer's right to privacy, and forbade it.
Legal Aid of Southeastern Pennsylvania (LASP) was the designated recipient of a cy pres award, funds that remained unclaimed after distribution of the settlement fund. LASP provides free civil legal assistance to those living in Bucks, Chester, Delaware and Montgomery county Pennsylvania, who cannot afford the services of a private attorney.
